Why every freelancer needs a contract

A freelance contract isn't about distrust — it's about protecting both parties. Without a written agreement, disputes over scope, payment, and ownership of work can become costly and stressful.

Australian freelancers are subject to both contract law and the Australian Consumer Law. A well-drafted contract ensures your terms are enforceable, your payment is protected, and your intellectual property remains yours until you're paid.

This template is designed for general freelance engagements. For high-value contracts or complex engagements, we recommend having a solicitor review your agreement.

What to include

Be specific. Vague scope is the #1 cause of freelance disputes.

FREELANCE SERVICE AGREEMENT

All intellectual property rights in the deliverables transfer to the Client upon receipt of final payment in full. Until final payment is received, the Contractor retains all IP rights.

6. CONFIDENTIALITY
Both parties agree to keep confidential any proprietary information disclosed during this project.

7. TERMINATION
Either party may terminate this Agreement with 7 days written notice. The Client shall pay for all work completed to the date of termination.

8. LIMITATION OF LIABILITY
The Contractor's total liability shall not exceed the total fees paid under this Agreement.

9. GOVERNING LAW
This Agreement is governed by the laws of [State], Australia.
